GENERAL RULES AND REGULATIONS FOR ONLINE CONTEST

Application

These rules and regulations (the “Rules”) shall apply to (the “Contest”) unless stipulated otherwise.

Eligibility

The Contest is open to legal residents of Vancouver Island, minimum of 19 Years of age, with valid BC Class 5 or 7 drivers Licence. No person who is employed by SMFL or its affiliate companies, and no family member of such employee, shall be entitled to enter the Contest.

How to Enter

There is no purchase necessary to enter the Contest.

Enter by visiting the page smfl.ca/win and complete all required portions of the form.

Value

No prize may be exchanged for cash, sold, or transferred to any third party.

A 12 month prepaid lease including taxes on the Vehicle is $14,370.72. There is no obligation to renew or buyout the lease after 12 months.

Odds of Winning

The odds of winning the Contest are dependent upon the number of entries received to the Contest between December 9, 2022 and January 8, 2024.

Each month one (1) name will be drawn from the entries to be declared a finalist.

On January 20, 2024 the thirteen (13) finalists will gather at 3851 Shenton Road for elimination games to narrow finalists to the winner.

Upon being declared a potential winner, the person will be required to answer, unaided, a time-limited mathematical skill-testing question. Upon correctly answering that question, the potential winner will be declared the winner. That person may also decline the prize as awarded, the prize will then be awarded to the runner-up with the same stipulations.

Liability

The winner acknowledges that the collection or use of any prize may be inherently dangerous and agrees to release and hold harmless SMFL for any and all damages they may incur through entering the Contest or through the collection or use of the prize. The winner also agrees to sign a standard release and waiver of liability prior to claiming the prize which will generally be provided.

Notwithstanding the execution or provision of the aforementioned standard release and waiver, each entrant and any potential or declared winner, by participating in and entering the Contest, releases SMFL , their subsidiaries, respective divisions, their parent corporations, their advertising and promotional agencies, their shareholders, officers, directors, employees, agents and representatives (hereinafter the “Beneficiaries”) from any and all liability for any and all damage, loss or liability suffered as a result of or arising from the entrant’s participation in the Contest or the acceptance or use of any Contest prize. In order to be declared a winner, and prior to obtaining the prize, any potential or declared winner agrees to sign a declaration to such effect in the release form. The guest(s) of a winner (or a parent or legal guardian in the case of a minor) will also have to sign such a declaration to that effect in the release form, failing which they will not be able to take part in the prize.

Release of Privacy Rights

By entering the Contest, each declared finalist consents to the contest organizers and their representatives using, at their sole discretion and if required, their name, photograph, likeness, testimonial related to the prize, place of residence and/or voice without compensation whatsoever and that, without limit as for the period of use, in any media and on a worldwide scale, for publicity purposes or for any purpose that may be considered relevant. By entering the Contest, finalists also agree to be bound by SMFL Privacy Policy.

General

Prize winner shall be responsible for all costs and expenses not explicitly stated to form part of the prize, including but not limited to taxes, fees, or insurance unless anything contrary is expressly provided for in the description of any such prize.

SMFL may at its sole discretion substitute a prize or a portion thereof with an alternate prize of similar nature of equal or greater value. Notwithstanding the foregoing, SMFL shall not be responsible to substitute a prize or portion thereof where such prize cannot be redeemed due to factors beyond its reasonable control.

SMFL reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this Contest, in whole or in part, in the case of the occurrence of an event, an error or any human intervention that could corrupt or affect the administration, safety, impartiality or the running of the Contest as provided in these Rules.

All decisions of SMFL or those of their representatives regarding this Contest are final and binding.

The winner also agrees to abide by any rules and regulations for pick up or delivery of any prize won.

Winner must provide proof of residency and employment, 3 references, credit application, active credit card information, have no outstanding judgements or collections.

Winner must provide proof of ICBC insurance on the Vehicle with $5,000,000.00 third-party liability, maximum deductible of $500.00, replacement insurance required.

12 months pre-paid lease with the option to purchase at the end (plus applicable taxes) 20,000 kilometer driving limit 16¢ plus tax for each kilometer over 20,000, if vehicle is returned. No excess kilometer charge if vehicle is purchased at maturity. Lessee responsible for maintenance at 6 months, lessee is responsible for maintaining the safety of the vehicle, dealer can terminate contract if lessee abuses the vehicle. If vehicle is returned at the end of the lease the lessee will pay for any broken, damaged or unsafe parts plus labour to repair; normal wear and tear is acceptable. Vehicle only eligible for use in Canada unless a cross border letter is received from the lessor.

The Vehicle will be kept free of any liens, fines or encumbrances at the winner’s expense. If the winner does not pay promptly any finds, or remove any liens or encumbrances, the Leasing Company may do so. Any money paid out by the Leasing Company will be charged back to the winner, plus any costs associated with removing any fines, liens and encumbrances.

By entering the Contest, all persons are deemed to have read and to have accepted these Rules.
